Colorado Massacre Suspect to Make New Court Appearance

Accused movie theater shooting suspect James Holmes is scheduled to make another court appearance on Monday, when he is likely to be formally charged with murder and attempted murder.

Prosecutors said last week they are considering pursuing the death penalty for Holmes, who allegedly killed 12 people and wounded 58 others July 20 at a midnight screening in Colorado of the new Batman film The Dark Knight Rises.

At his first court appearance a week ago, Holmes said nothing and looked dazed and unemotional. The judge informed him that he could face first degree murder charges.

Authorities are still investigating Holmes and what might have turned a former Ph.D. student in neuroscience into a suspected mass murderer. Holmes has refused to talk to police.

He is accused of tossing a tear gas bomb into the theater before shooting at the audience with several weapons. Police arrested him without a struggle in the theater parking lot.
